General Terms of Use

of the LBOXLD application

and Privacy Policy

Article 1: Scope of application

These terms govern the relationship between Lacmé (hereinafter: "the service provider") and the subscribed user (hereinafter: the user or "the subscriber") regarding the use of the LBOXLD application (hereinafter "the application") and the services provided by Lacmé through this application.

The user's acceptance of these terms occurs by accepting the installation of the application online. Before installation, you can view these terms from the Store, and you can subsequently find them at any other time via the link under the corresponding menu in the application. You will thus be able to learn about any possible changes at the time of application updates, changes that we recommend you check periodically.

The date of the last modification is indicated at the top of the Terms to allow you to immediately know if they have changed since your last reading. In the event of a substantial modification, a notification email referring you to the modified terms would be sent to you one month before the modification comes into force. You could then make arrangements to, for example, prevent any future updates to the application or to terminate the service offered by the application if you wish, without penalty and without any right to compensation. If you do not purchase our products for professional use, continued use of the service more than 4 months after the notified modification constitutes acceptance.

Article 2: Purpose of the Lacmé application

Article 3: Required environment

In addition to the dedicated L.BOX LD gateway, and for optimum service, use of the application assumes the existence and proper functioning of the following devices (hereinafter: the devices): smartphone or equivalent device, with a data subscription, used in an area effectively covered by the network provider + internet access of the L.BOX LD gateway with sufficient available upload and download speed (recommended >50 kb/s available for the gateway). A malfunction or failure of these devices, individually or in their connection/interconnection, may render the application inoperative. The user must therefore ensure the maintenance and proper functioning of these devices, as well as the effectiveness of their contractual relationships with their suppliers. Except for the gateway, which is part of the system sold by Lacmé without which its application cannot function, Lacmé does not and cannot intervene on any of these devices which fall under the sole responsibility of the user and their suppliers.

Article 4: Creation of your account, authorizations and confidentiality of collected data

In addition to the necessary authorizations requested by the Android operating system and granted by you when installing the application, the only essential data that we ask you to voluntarily provide when opening your account and to keep up to date are those we need to create your account, reserve space on our server and contact you when needed for the proper management of the service and to maintain it at a high level. These are a valid email address, as well as your first and last name in order to address you in a personalized way. These details are not communicated to third parties, unless they directly participate in the service provided by Lacmé and only for the proper functioning of the service. Any such third parties are contractually bound with Lacmé in this regard, including a strict commitment to confidentiality and non-disclosure of data.

To exercise these rights or for any question about the processing of your data in this system, you can contact our Data Protection Officer either by sending an email to commercial@lacme.com (or via the "Contact us" section of our website), or by sending a letter to Lacmé's Customer Service at the address indicated below, making sure in all cases to indicate as a customer reference the email address registered to use the application.

The only other data we may retain are the measurements sent by your energizer, in order to display them graphically in the application but also to better understand its behavior depending on the environment over time. These are not personal data within the meaning of the law.

Article 5: Free application update service

We wish to offer you the service of possible application updates free of charge. The only consideration for this free service is that, at most once a month, we will send you an informational email about our products that may interest you. You can always unsubscribe from their mailing list via a simple attached link. In this case, access to some or all of the new features generously added (since your registration to the application) during successive updates may be limited or blocked. Unlocking access to these new features (without having to agree to receive informational emails about our products) will in this case be offered via the purchase of a paid updated version of the application, or via free re-registration to our mailing list, from an option offered in the application.

Any significant change in our data management policy or in the free application update service will be subject to a modification of these terms and a message sent to the email address registered for the proper functioning of the application.

Article 6: Liability and warranty

Our objective is to make your electric fence even more effective by allowing you to remotely monitor and adjust the performance of your energizer. However, this can never substitute for frequent direct on-site checks, especially in the event of service malfunction which could lead to an erroneous assessment of the state of your fence and therefore poor management of it. LACME's liability is, in any case and on any grounds, limited to the terms of the legal warranty (art L212-4 to L212-14 of the consumer code at the date of this version) and the manufacturer's warranty (L212-15 and L212-16 of the same code) described in the user manual of your energizer, available and downloadable on the website www.lacme.com. In particular, this liability cannot under any circumstances be incurred due to any damage whatsoever, material or otherwise, direct or indirect, resulting from the stoppage or malfunction of the application.

Article 7: End of service

Lacmé reserves the right to terminate the service provided by the application, unilaterally, and in particular without notice in the event of abnormal use of the service, and in particular if such use may affect data security. The user may at any time decide to discontinue their subscription by uninstalling the application. The energizer will continue to function normally in this case.

Article 8: Continuity and applicable law

The ineffectiveness of one or more provisions of these Terms, for whatever reason, does not affect its other terms which remain valid. French domestic common law, solely applicable to the relationships arising directly and indirectly from these Terms, replaces any provisions that may be ineffective.

Article 9: Jurisdiction

For professional clients, the courts of Sarthe (France) have sole jurisdiction in the event of any dispute, including emergency and interim proceedings. Their jurisdiction is nevertheless optional in cases where LACME is the claimant.

For non-professional clients, the rules of French domestic consumer law apply.
